We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not:

4. Permitted & Prohibited Use

4.1 Permitted Use

4.2 Prohibited Use

You may not use the Site to:

5.2 Representations

You represent that you own or control all rights to your User Content, it is accurate, not confidential, and does not violate any law or third-party rights.

5.3 Moderation

We may (but are not obligated to) monitor, edit, or remove User Content that violates this Legal Notice or is otherwise objectionable.

5.4 No Compensation

You are not entitled to compensation for User Content. We may use it without attribution or payment.

6. Product Information & Pricing

6.1 Accuracy

We strive for accurate product descriptions, specifications, colors, and pricing. However, we do not warrant that descriptions are complete, reliable, current, or error-free. Product images may vary from actual items due to monitor differences, lighting, and manufacturing variations.

6.2 Pricing

• All prices in US Dollars (USD).
• Prices exclude sales tax (calculated at checkout based on shipping address).
• Prices exclude shipping fees (see Shipping Policy).
• We reserve the right to correct pricing errors. If an error is discovered, we may contact you for instructions or cancel the order with a full refund.

7. Orders & Contracts

7.1 Order Placement

Your order is an offer to purchase. We accept orders at our discretion. Acceptance occurs when we send a shipping confirmation email. We may refuse or cancel orders for any reason, including inventory errors, pricing errors, suspected fraud, or violation of these Agreements.

7.2 Payment

• Payment processed via Shopify Payments, PayPal, Apple Pay, Google Pay.
• Full payment authorized at checkout; captured at shipment.

7.3 Sales Tax

Our cycling apparel is designed for recreational and athletic use. It is not personal protective equipment (PPE), medical device, or safety gear. Users assume all risks of use. Consult a professional for specific performance or safety needs.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDYAZZ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE RELEVANT ORDER IN THE PRIOR 12 MONTHS.

8.4 State Law Variations

Some states (e.g., New Jersey) do not allow exclusion of incidental/consequential damages. In such states, our liability is limited to the maximum extent permitted by law.

• Your User Content
• Your violation of these Agreements
• Your violation of any third-party rights
• Any unauthorized use of your account

10. Governing Law & Jurisdiction

This Legal Notice and all Agreements shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law principles.

You agree to submit to the exclusive jurisdiction of the state and federal courts located in Multnomah County, Oregon for any dispute arising from or related to these Agreements, the Site, or your purchases.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal claim, you agree to attempt good-faith informal resolution by contacting support@trendyazz.com. We will respond within 30 days.

11.2 Binding Arbitration

If informal resolution fails, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. Arbitration shall be conducted in Portland, Oregon (or remotely by mutual agreement). The arbitrator's decision is final and binding.

11.3 Class Action Waiver

YOU AGREE THAT DISPUTES SHALL BE RESOLVED INDIVIDUALLY, NOT AS A CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR PRIVATE ATTORNEY GENERAL ACTIONS.

11.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement. Small claims court actions are permitted if within jurisdictional limits.

11.5 Opt-Out

You may opt out of binding arbitration by emailing legal@trendyazz.com within 30 days of your first purchase or first Site use, whichever is later. Opt-out does not affect other terms.

12. Privacy & Data Protection

Your privacy is important. Our data practices are detailed in our Privacy Policy, which is incorporated by reference. Key points:

13. Modifications

14. General Provisions

14.1 Entire Agreement

These Agreements constitute the entire agreement between you and Trendyazz LLC regarding the Site and your purchases.

14.2 Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in full force. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

14.3 Waiver

No waiver of any right or remedy shall be effective unless in writing. Failure to enforce a provision does not constitute a waiver.

14.4 Assignment

You may not assign or transfer these Agreements. We may assign freely.

14.5 Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control (natural disasters, pandemics, government actions, carrier failures, etc.).

14.6 Electronic Communications

You consent to receive communications electronically (email, Site notices). Electronic communications satisfy any legal requirement for written notice.

14.7 No Third-Party Beneficiaries

These Agreements do not create rights in any third party.

14.8 Survival

Sections 3, 5, 8, 9, 10, 11, 12, and 14 survive termination or expiration.
